Terms of Service

1. Acceptance

By creating an account or using TenderClaw (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms are governed by Swiss law.

2. Description of Service

TenderClaw is an AI-powered platform that helps Swiss companies discover public tender opportunities on Simap, identify matching grant programs (Innosuisse, EIC, and others), and draft application materials. The Service is provided to registered business users.

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your credentials.
  • Each account is for a single company; you may invite team members from your organisation.
  • You must be at least 18 years old and authorised to act on behalf of your company.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Reverse-engineer, scrape, or attempt to extract tender data in bulk outside normal usage.
  • Upload malicious files or content that violates third-party rights.
  • Resell or sublicense access to the Service without our written consent.
  • Attempt to circumvent any access controls or rate limits.

5. AI-generated content

The Service uses large language models to generate tender match reasoning, proposal drafts, and form fill suggestions. AI-generated content is provided as a starting point only. You are solely responsible for reviewing, verifying, and finalising any documents submitted to contracting authorities or grant bodies. TenderClaw makes no warranty that AI-generated content is accurate, complete, or suitable for submission.

6. Your content

You retain ownership of all company information, documents, and data you upload (“Your Content”). You grant TenderClaw a limited licence to process Your Content solely to provide the Service. You represent that you have the right to upload Your Content and that it does not violate any third-party rights.

7. Pricing and billing

During the beta period, the Service is provided free of charge. We will give at least 30 days' notice before introducing paid plans. Continued use after pricing takes effect constitutes acceptance of the applicable fees.

8. Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance with or without notice. During beta, the Service is provided “as is” without uptime commitments.

9. Limitation of liability

To the fullest extent permitted by Swiss law, TenderClaw is not liable for any indirect, incidental, or consequential damages arising from use of the Service, including lost tender opportunities or incorrect AI-generated content. Our total liability for any claim shall not exceed the fees paid by you in the preceding 12 months.

10. Termination

You may close your account at any time by contacting hello@tenderclaw.com. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 90 days unless legally required to be retained.

11. Changes to terms

We may update these terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

12. Governing law and jurisdiction

These terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
